Effective August 1, 2020, Ontario commissioning legislation permits the practice of remote commissioning. You must inquire with your receiving party to ensure they will accept a document that has been commissioned remotely, as nothing in the Ontario commissioning legislation or its regulation obliges a receiving party to accept a document that has been commissioned remotely. Note that only commissioning services are permitted through remote services at this time.

A Commissioner of the Oaths for taking affidavits are permitted to administer oaths, take affidavits and statutory declarations. The Commissioner of the Oaths will be required to verify your identity, administering an oath, witnessing the deponent’s signature. The commissioner must satisfy himself or herself as to the genuineness of the deponent’s signature, and executing the document by signing.
Remote commissioning is an authentication and signature process for taking affidavits and statutory declarations that uses audio-visual technology. It is therefore not conducted in the physical presence of the commissioner. Online commissioner services are easy, fast, reliable and cost-effective. The COVID-19 pandemic has changed the legal method in which witnessing a document from a Commissioner of the Oaths can be done in Ontario. Documents may now be witness remotely, and online.
